General business terms and conditions of Torsten Will

Torsten Will reserves the right to take action against infringement under criminal and civil law.

1. Form of contract

1.1 The conclusion of contracts between Torsten Will and the contractor for the mutual provision of services, as well as amendments and/or supplements thereof, are to be in written form.

1.2 The present terms and conditions are prioritized to counter terms and conditions of the contractor.

2. Services of Torsten Will

2.1 The consultants are to provide their services by themselves. In case of an appointment can not be adhered to due to force majeure, sickness, accident or other circumstances beyond control, the consultant represented by Torsten Will is entitled to engage an alternate consultant or providing an alternate date to render his/her services under exclusion of any indemnification.

2.2 Complexity, form, topic and purpose of the services are obvious from the quotation and well-noted by the contractor.

2.3 The contractor acknowledges the copy right of the trainers for the works provided by him/her (training documents, etc.). Copying and/or distribution of the above mentioned works by the contractor subject to the prior written agreement of the consultant.

2.4 With the booking of a consultant via Torsten Will the organiser/contractor accepts that the photo, audio and video tapes recorded during the event can be used for media and advertising efforts.

2.5 The contractor is committed to secrecy of any relevant matters, which have become known to him due to collaboration with the consultant.

2.6 The contractor is obliged to carefully select media companies, audio and transmission technics, seminar/congress hotels as well as other third party who are engaged by the contractor for effecting the order. The contractor selects those parties with exclusive interest to a best possible execution of the planned event resp. the seminar/congress.

3. Assurance of services

3.1 30 days before booking date at latest 100 % of the fee are due for bookings of consultants via Torsten Will.

3.2 Should there no payment have taken place 30 days before booking date,there is no claim to execution of the seminar by the contractor. The booking is binding to the organizer of the seminar/congress. However, it is possible at any time to agree on an alternate date in written subject to the adherence of terms. A cancellation free of charge is possible up to 60 days prior to the event. Up to 30 days prior to the event we charge you with 50 % of the order volume. If a booking date cannot be fulfilled by the consultant due to force majeure, sickness, accident or any other circumstances beyond control of the consultant, the consultant is entitled to make up the service on a newly agreed date without any claim to indemnification.

3.3 The contractor is responsible for hotel reservations, (and possible cancellations) as well as hotel fees and travel expenses in usual scope of a business date.

4. General Conditions

4.1 Should single terms of these general terms and conditions be or become invalid, it will not effect the validity of the other terms and conditions. The parties then will execute the conditions with an operative alternate term, which corresponds most to the object of the omitted term.

4.2 For the conditions and execution hereof solely Maltese law is applied.

4.3 Exclusive jurisjunction for all claims of the with this business conditions coherent contract is the registered office of Torsten Will.

4.4 The contractor/organiser agrees to be informed about actual causes and important events of Torsten Will via E-mail, telephone, Fax or mobile.

5. Moreover, for participants of seminars of Torsten Will or his partners the following is valid:

The participation at the seminar/coaching exclusively serves the purpose of education. As participant you have the full responsibility for yourself and your actions in and outside the event and answer for damages by yourself.

At a possible recording with vision and sound during the seminar you agree that the consultants and Torsten Will have the right to use your name, voice, and presentation as picture, photo, film or videorecording, in printed media, on TV, in the internet free of charge as video and any other media for the purpose of advertisement, publication, promotion and all compulsory allowed presentations. You hereby release the consultants of any liability that could occur from the use of your name, your voice and your presentation by picture, photo, film or video recording.

We explicitely have to point out that our seminars and coaching are no therapy and no replacement for a therapy.
